Terms of Service

1. Parties and Subject of the Subscription Agreement

1.1 These Terms of Service ("ToS") govern the relationship between the WebTV platform swiss-sport.tv operated by Swiss Sport TV and the viewers (customers) who pay for the service.

1.2 Access to paid content is only permitted via the personal login provided by swiss-sport.tv. Single purchases or subscriptions grant access to the paid swiss-sport.tv programming for personal use only. Users must prevent any redistribution of login information or paid content.

2. Changes to the Program Offer

2.1 Information about the scope of swiss-sport.tv programming is provided on the website swiss-sport.tv. Swiss Sport TV may involve third parties to deliver the service.

2.2 Swiss Sport TV reserves the right to add to, expand, reduce, or otherwise modify the swiss-sport.tv program offer at any time.

2.3 As long as the overall nature of the purchased or subscribed swiss-sport.tv programming remains intact, this does not entitle the subscriber to extraordinary termination. Otherwise, the subscriber may terminate the subscription agreement early without financial consequences by the effective date of the change. If the subscriber does not terminate, the change is deemed accepted.

3. Subscription Fees

3.1 Fees for the swiss-sport.tv program offer are determined by the current prices published on swiss-sport.tv for paid content. By purchasing, the customer accepts the applicable fees.

3.2 The customer agrees to pay the fees in advance for the entire contract duration according to the agreed payment period. Accepted payment methods include common credit cards and Twint.

3.3 In the event of payment default, Swiss Sport TV may revoke access and/or take other measures to prevent further damages until full payment is received or terminate the subscription agreement without notice or compensation. No compensation claims arise from justified revocation of access, and the payment obligation remains. If Swiss Sport TV terminates the subscription agreement, the customer owes fees until the contract expires.

3.4 Swiss Sport TV may adjust the fees at any time. Fee increases are communicated to the subscriber appropriately. If a fee increase results in higher costs for the subscriber, they may terminate the agreement early without financial consequences. If they do not, the change is deemed accepted. Fee adjustments due to changes in taxes or levies (e.g., VAT) are not considered fee increases and do not entitle early termination.

4. Registration Fee

Swiss Sport TV does not charge a registration fee.

5. Program Guide

Customers are informed of content start times via the video player on the swiss-sport.tv website.

6. Broadcast Interruptions

6.1 Technical issues such as livestream interruptions, video quality problems, bandwidth issues, or unavailability of recordings do not entitle refunds, even partial ones. The purchase price grants access to the paid content pages and is independent of the functionality of individual videos or livestreams. Swiss Sport TV strives to maintain content functionality but relies on technical prerequisites such as internet availability.

7. Customer Responsibilities

7.1 Customers are responsible for providing, installing, and operating all devices (PC, notebook, tablet, smartphone, smart TV) and connections (landline internet, mobile network) required to access the purchased swiss-sport.tv content. Swiss Sport TV aims to make swiss-sport.tv content accessible on all devices, platforms, and browsers but does not guarantee functionality.

7.2 Customers must immediately notify Swiss Sport TV of any changes to their provided information (e.g., email address) after the contract is concluded. If the customer wishes to change their selected payment method, they must notify Swiss Sport TV in advance.

8. Liability of Swiss Sport TV

8.1 Swiss Sport TV is not liable for damages to customer devices caused by the use of swiss-sport.tv. It is also not liable for device incompatibility or data loss during software updates.

8.2 Swiss Sport TV is not responsible for disruptions caused by force majeure or circumstances outside its control, such as actions by telecom providers or power outages. It is also not liable for third-party misuse or damages.

9. Copyright

Recording broadcasts for use outside the private circle (family, friends) is prohibited and violates copyright law. Public performance or distribution of swiss-sport.tv content without permission from Swiss Sport TV is prohibited.

10. Misuse

10.1 Customers must comply with these ToS and legal provisions when using Swiss Sport TV services. Any unauthorized use of swiss-sport.tv content or platform is strictly prohibited.

10.2 Swiss Sport TV may revoke access or terminate the subscription agreement without notice in cases of misuse. Payment obligations remain, and no compensation claims arise from justified access revocations.

11. Data Protection

Swiss Sport TV commits to handling customer data carefully and in compliance with Swiss data protection laws. By accepting these ToS, the customer consents to Swiss Sport TV collecting and processing their personal data as described.

12. Duration and Termination

12.1 The contract starts upon online purchase completion. Services are provided immediately.

12.2 Single purchases last one year and do not renew automatically. Access is valid for the purchased content during the contract period.

12.3 Monthly subscriptions last one month and renew automatically. They can be canceled at any time with no notice period at the end of a subscription period.

12.4 Annual subscriptions last one year and renew automatically. They can be canceled at any time with no notice period at the end of a subscription period.

12.5 Early termination requires email notification to Swiss Sport TV. Fees are owed until the contract expires unless otherwise specified in these ToS.

12.6 Upon contract termination, all outstanding fees become due.

13. Final Provisions

13.1 Swiss Sport TV reserves the right to amend these ToS at any time. Changes are communicated appropriately. If changes are disadvantageous, customers may terminate the agreement early without financial consequences.

13.2 The transfer of the subscription agreement or related rights and obligations requires mutual written consent. Swiss Sport TV may transfer the agreement to another company it controls without customer consent.

13.3 The agreement is governed exclusively by Swiss law. The place of jurisdiction is Hochdorf.
